  • Terms & Conditions for Full Facility Profiles
  • BENEFITS OF A FULL FACILITY PROFILE
    • ONE FREE FITPRO PROFILE FOR AS LONG AS YOUR FACILITY PROFILE IS ACTIVE
      • Show off your work as an individual as well as a business
    • APPEAR AHEAD OF BASIC PROFILES IN SEARCHES
      • Be seen towards the top of the page of search results with your chosen image or logo
    • APPEAR IN SEARCHES BASED ON WHAT YOU OFFER
      • When someone searches for a Facility with certain equipment or offerings, if you fully or mostly match their search terms, you will appear
        • This is not possible for Basic profiles so they will not appear.
    • APPEAR ON OUR NATIONWIDE INTERACTIVE FITNESS FACILITY PROFILE MAP
      • Allow potential clients find you based on your location and proximity to them
    • AVAIL OF DISCOUNTS FROM OUR OFFICIAL PARTNERS
      • Exclusive access to discounts from our Official Partners on their Products, Services and Equipment (See below: Official Partners)
    • CUSTOM URL
      • Easily direct current and potential clients to your profile with a custom URL e.g. thegymadvisors.ie/YOURGYM
    • SOCIAL MEDIA BOOSTING OF YOUR FACILITY:
      • By having a profile on The Gym Advisors website, The Gym Advisors will feature a profile of your Facility or highlight an event you are hosting on at least one of The Gym Advisors' social media channels each subscription year, such decision to be made at the absolute discretion of The Gym Advisors.  Any additional featuring of your Work, Facility, Profile, Staff, 5 Star Reviews, Events, Job Openings, etc. will be at the absolute discretion of The Gym Advisors.

      • Want us to change how we do something? Want us to add a feature? Simply tell us and we will happily consider your suggestion.

 

  • WHAT’S IN A FULL FACILITY PROFILE?
    • NO Adverts
      • Your profile is yours, people browsing your profile will not be distracted by adverts for other products or services on your profile page
    • Facility Name
    • Facility Address
      • With Embedded Google Map
    • Allow potential clients to contact you via:
      • Email
      • Facebook Messenger
      • Phone (Call Now Button)
    • Description Section
    • Equipment Section
    • Offerings Section
    • Other Information Section
    • Social Media Links Section
    • Image Gallery consisting of 5 images of your choice (See below: General Terms and Conditions)
    • Embedded YouTube clips (See below: General Terms and Conditions)
    • List of FitPros connected to your Facility and links to their profiles (See below: Linked FitPros)
    • Fully moderated ratings and reviews from past and present clients (If any received and accepted) (See below: Ratings and Reviews)
    • Your public replies to these reviews (See below: Ratings and Reviews)
    • The average ratings across the multiple characteristics upon which you have been rated on (See below: Ratings and Reviews)
  • HOW MUCH?
    • Check “Subscription” page in your Dashboard for your price, duration and special offers.
  • LINKED FITPROS
    • In order to give the fullest possible picture of your Facility, FitPros who work in, operate out of, or run classes in your Facility may request to link their profile to yours (If you accept, links to those FitPros will then appear on your profile and links to your profile will appear on theirs).  To ensure accuracy of information, Linked Profiles must have one of these genuine and significant types of business relationship as per their agreement to The Gym Advisors Terms and Conditions where you and they warrant and agree that all information you and they provide on this website is true, accurate, current, and complete.
      • Once a FitPro makes the request, you will receive an email that gives you the option to accept or reject the request
        • If you accept the request, the link will be formed
        • If you reject the request, the FitPro will receive a notification of this and will not be able to send another request
          • In case of a mistaken rejection, you may still return to the original request at any point in the future and Accept the request which will override the rejection and the link will be formed.

IF YOU RECEIVE A LINK REQUEST FROM A FITPRO WHO DOES NOT WORK IN, OPERATE OUT OF, OR RUN CLASSES IN YOUR FACILITY, YOU SHOULD REJECT IT AND INFORM US VIA EMAIL ON INFO@THEGYMADVISORS.IE

  • If the relationship between two Linked Profiles breaks down, there is the option to end the link by entering the “Link Profiles” section on your dashboard, and clicking “Remove Link” on the FitPro in question
  • The Gym Advisors will not attempt to mediate in these situations, if the relationship returns to its previous position, the profiles can be re-linked again in the future using the method described above.

 

  • RATINGS AND REVIEWS
    • Reviews, and their associated Ratings, go through a moderation process that includes the input of the Reviewer, the Profile Owner and The Gym Advisors’ Team.
    • The intention of this is to ensure that only Fair, Honest and Non-Libellous reviews are published on thegymadvisors.ie
    • The Gym Advisors’ Team use a detailed set of criteria when assessing whether reviews are deemed as Fair, Honest, and Non-Libellous.
    • You may reply publicly to reviews that have passed the moderation process by navigating to your profile and clicking “Publicly Reply to this Review”
  • OFFICIAL PARTNERS
    • We have carefully selected our Official Partners from across a broad range of sectors who provide different products and/or services that could be of use to you in and out of the gym or studio. They have kindly provided a discount and/or free trial on some, or all of, their range.
  • The Gym Advisors does not receive any gratuities from these Official Partners.
    • We took this decision to ensure that our Partners can provide as much of a discount, or as long of a free trial as they possibly can to our valued subscribers.

 

  • However, while we engage with the businesses to ensure their products and/or services will be beneficial to the Profile Owners and their clients, we cannot guarantee their quality or other specifics. Any purchase made, service acquired, subscription or contract entered into by the Profile Owners or their clients is done at their own risk and with the individual companies. We do not accept responsibility for any issues in this process and will not mediate in these matters. If you would like to bring something to our attention about your experience with our Partners, you may do so by emailing info@thegymadvisors.ie with the subject line “The Gym Advisors’ Partners”

 

  • You may share Promotional codes and links with your clients, but it is not permitted to distribute same to other people within the Fitness Industry who are not Profile Owners on The Gym Advisors.

 

 

  • PREVENTING EMAIL SPAM
    • The Gym Advisors has been built to make it easier for individuals to find a Fitness Facility or FitPro that suits them and their goals.
    • Owners and Managers of Fitness Facilities, as well as FitPros, are bombarded with emails selling to them. We are not, and will not become, to best extent possible, a conduit for this. Only messages from potential clients or people with genuine enquiries will pass through our spam filter.
      • If there is a company or business who provide a service that may help members of the fitness industry, and you would like to avail of a discount from them, you can let The Gym Advisors Team know by emailing info@thegymadvisors.ie with the subject line “Potential Partner Recommendation”

 

  • Terms & Conditions for Basic Facility Profiles
  • WHAT’S IN A BASIC FACILITY PROFILE?
    • Facility Name
    • Facility Address
      • With Embedded Google Map
    • Ability to allow potential clients to contact you via:
      • Email via our Site rather than displaying your email address

The above information applies if this information can already be found in the public domain, in places such as Google, Facebook, Instagram, etc.

Adverts will also be displayed on Basic Profiles

 

  • HOW MUCH?
    • There is no charge for a Basic Profile. (See below: Upgrade to a Full Profile)
  • LINKED FITPROS
    • In order to give the fullest possible picture of your Facility, FitPros who work in, operate out of, or run classes in your Facility may link their profile to yours (Links to those FitPros will then appear on your profile and links to your profile will appear on theirs).  To ensure accuracy of information, Linked Profiles must have one of these genuine and significant types of business relationship as per their agreement to The Gym Advisors Terms and Conditions where they warrant and agree that all information they provide on this website is true, accurate, current and complete.  To ensure that you are happy to have the FitPros link to you, you will receive an email notifying you of the link made by the FitPros.
    • If, once you receive this email or at any time thereafter, you wish to remove a FitPro from your profile, you may email The Gym Advisors Team at info@thegymadvisors.ie with the subject line “Remove Profile Link” to request their removal from your Profile.  The FitPro will be notified of the request.
    • If the relationship between your Facility and a linked FitPro ends, The Gym Advisors will not attempt to mediate in these situations. If the relationship returns to its previous position, the FitPro can re-link again in the future using the methods described below.

  • CREATING A BASIC PROFILE
    • If there is no Basic Profile for your Facility, you can request that we create one by emailing info@thegymadvisors.ie with the subject line “Create a Basic Profile”.  You can also contact us to create a Full Profile.
    • If we proceed with creating this Basic Profile we will be in touch to confirm contact and other details.
  • UPGRADE TO A FULL PROFILE
    • If a Basic Profile of your facility already exists, you may upgrade to a Full Profile and unlock all of the associated benefits at any time. You can do this in one of the following two ways:
      1. Click the “Upgrade Profile” link on the Basic Profile in question, fill out the Contact Form and await contact from The Gym Advisors
      2. Email The Gym Advisors Team at info@thegymadvisors.ie with the subject line “Upgrade Profile” and detailing the Profile you wish to subscribe for.
      3. Once you have made contact, we will seek confirmation of your authority to make the subscription and your entitlement to the profile.
        • We may do this via phone, email, messaging apps and/or face to face meetings. 
    • If a Basic Profile does not already exist, you may click any of the many “Create Profile” Links located throughout the site and follow the standard Sign Up Process.
  • OPT OUT
    • You may opt out of having a profile on The Gym Advisors at any time by emailing info@thegymadvisors.ie with the subject line “Opting Out Of Basic Profile” and describing, in the body of the email, why you are doing so (if you so wish).

 

Terms & Conditions for FITPROS

  • BENEFITS OF A FITPRO PROFILE
    • AVAIL OF DISCOUNTS FROM OUR OFFICIAL PARTNERS
      • Exclusive access to discounts from our Official Partners on their Products, Services and Equipment (See below: Official Partners)
    • APPEAR IN SEARCHES BASED ON LOCATION, AREAS OF EXPERTISE AND SERVICES OFFERED
      • When someone searches for a FitPro in a certain location, or with specific expertise or services, if you fit the bill, you will appear!
    • APPEAR ON FACILITY MAP
      • When a searcher clicks the pin of a Facility you work in, operate out of, or run classes in, a pop up with a link to your Profile will appear (See below: Linked Facilities)
    • CUSTOM URL
      • Easily direct current and potential clients to your profile with a custom URL e.g. thegymadvisors.ie/YOURNAME
    • SOCIAL MEDIA BOOSTING OF YOUR WORK:
      • By having a profile on The Gym Advisors website, The Gym Advisors will feature a profile of your work or highlight an event you are hosting on at least one of The Gym Advisors' social media channels each subscription year, such decision to be made at the absolute discretion of The Gym Advisors.  Any additional featuring of your Work, Facility, Profile, Staff, 5 Star Reviews, Events, Job Openings, etc. will be at the absolute discretion of The Gym Advisors.

    • Offerings Section

      • To link to a Full Profile, the following procedure will apply:
        • On your Dashboard, click “Link Profiles”
        • Search for the Facility using the text box
        • When the correct Facility appears, click “Link Me To This Fitness Facility”
        • An email is sent to the Profile Owner to inform them the request has been made
          • If they accept, they are added to your profile and you are added to their profile.
          • If they reject, you receive a notification of this and you will not be able to send another Link Profile Request
            • In case of mistaken rejection, the Facility may return to the original request at any point in the future to Accept the request, which will override the previous rejection and the link will be formed
      • To link to a Facility with a Basic Profile, the following procedure will apply:
        • On your Dashboard, click “Link Profiles”
        • Search for the Facility using the text box
        • When the correct Facility appears, click “Link Profile”
      • To link to a Facility without a Basic Profile (i.e. It does not currently exist on The Gym Advisors), the following procedure will apply:
        • On your Dashboard, click “Link Profiles”
        • Search for the Facility using the text box
        • If the correct Facility does not appear, email info@thegymadvisors.ie , telling us the name, location and any other relevant information
          • If we add this location, we will let you know via email and you can then Link your Profiles using the procedure described above
    • If the relationship between two Linked Profiles breaks down, there is the option to end the link by entering the “Link Profiles” section on your dashboard, and clicking “Remove Link” on the relevant link in question

GENERAL Terms & Conditions

  • You warrant and agree that all information you provide on this website is true, accurate, current and complete and that any linkages you make to a Fitness Facility of FitPros is true, accurate, current and complete.
  • You warrant and agree that all information you provide on this website will be kept up to date, and any changes in situation or circumstance will be accurately reflected on your Full Profile.
  • You warrant and agree that you will not use The Gym Advisors to advertise, or seek to promote or sell, the products or services of any other company than that which comes expressly under the umbrella of your profile.
  • You undertake that you will safeguard your account information and will supervise and be completely responsible for any and all use of your account by anyone other than you.
  • You possess the legal authority to enter into this contract and to use this Website in accordance with all terms and conditions herein.
  • You have obtained the appropriate permissions for any images and videos you post or embed on this website.  
  • Warranty and Indemnity: You warrant that the material provided by you on the website does not infringe the intellectual property rights or privacy rights of any third party, is not defamatory, obscene, blasphemous or in breach of any law or regulation and that you have undertaken all relevant searches including but not limited to trademark searches if applicable.  You agree fully to indemnify us and hold us harmless from all costs, losses and expenses including legal fees arising from any breach of this warranty.
  • You agree that you will not use any part of this website to advertise products or services which are not specifically related to the business your profile represents, or that is not an Official Partner of The Gym Advisors.
  • You agree that you will accept reviews that are Fair, Honest, and Non-Libellous
  • You agree to co-operate in any investigation The Gym Advisors may instigate based on rejected reviews including responding to e-mails, phone calls and attending face-to-face meetings.  The Gym Advisors will have final say and discretion on the acceptance of reviews.
  • The Gym Advisors reserve the right to edit or delete content which does not adhere to the ethos of the Website and these Terms and Conditions.  The decision of the Gym Advisors is final in this regard.
  • The Gym Advisors reserve the right to suspend or delete accounts which do not adhere to these Terms and Conditions. The Gym Advisors operates a Notice & Take Down policy to address complaints and posting of inappropriate or unauthorised information. You agree to co-operate in any investigation The Gym Advisors may instigate based on the Notice & Take Down policy including responding to e-mails, phone calls and attending face-to-face meetings.
  • You agree to credit and promote the winners of competitions run by The Gym Advisors and that you will credit the related prize to be used to purchase, or put toward the purchase of, services or products from you or your facility. The pre-agreed upon amount of the prize will be paid to you by The Gym Advisors (if applicable).
  • The Gym Advisors reserve the right to change the characteristics upon which Facilities and FitPros are rated on without prior notice.
  • Payment terms: You agree that all fees for providing the website facility (all money) is to be paid in advance of availing of the services of The Gym Advisors.
  • The Gym Advisors reserves the right to change pricing structures without prior notice. Any monies already paid will be honoured to the end date of the then current payment term.
  • In the event of your non-adherence to these Terms and Conditions or breach of the ethos of the website, The Gym Advisors reserve the right to terminate your usage of the website and remove and delete your Profile from the website immediately without refund of any remaining subscription or any compensation.
  • You undertake that any and all claims made in your facility’s advertising relating to your rating on The Gym Advisors will be truthful and reflect the most current rating and display the date on which the rating was true.  Any infringement of this undertaking will result in your immediate deletion from the Website. 
  • In the event that you cease to be listed on the Website you agree and undertake to remove all references to the Gym Advisors on any advertising from the date of cessation and remove all references to The Gym Advisors from your website and all your social media channels.
  • If you cancel or delete your profile, all information will be deleted from our servers. Once a profile is deleted, a replacement one is not allowed to be created for a minimum of one year.  No refund of any remaining subscription or any compensation will apply if you cancel your subscription or delete your profile.
  • If you cancel your relationship with The Gym Advisors or it is cancelled by The Gym Advisors during a trial period or during a time of reduced subscription fee, you relinquish all entitlements to a further trial period or time of reduced subscription fee, even if you attempt to return before your original trial period or reduced subscription fee would have ended.
  • We provide you with a facility to host your information on our website.   We do not verify your information or the veracity of reviews.  You have full access to upload, amend and delete your information.  To enable us to fulfil our services to you we will collect certain information from you.  See our Privacy Notice for further information.
  • No variation of these terms will be valid unless we agree in writing to the variation.
  • You may not assign these terms and our agreement without our prior written consent.
  • A change in ownership and/or management of your Facility or the business represented by your Profile, may result in relinquishing rights to any price freeze, special offer price, and/or free trial.
  • No forbearance or delay by us in enforcing rights under these terms will prejudice or restrict rights and no waiver of any breach of such rights or waiver of the rights will be deemed to be a waiver of any other right or of any later breach.
  • In the event of any dispute between us we will endeavour to agree the matter between us and in default of agreement the matter will be referred to mediation by an independent mediator agreed upon by us and in the absence of agreement within 15 days of mediation being suggested, the mediator shall be appointed by the President of the Law Society at the request of either of us.  We will be jointly responsible for the costs of the mediator.  In the event that the matter is not resolved by mediation within 30 days of being referred to mediation, the appointed mediator shall then be requested to act as an expert and decide the matter acting as expert and we agree to be bound by the decision of the expert and we agree to be jointly responsible for the costs of the expert.
  • Nothing in these terms shall constitute or be deemed to constitute a partnership or joint venture or the relationship of principal and agent or employer and employee.
  • All notices shall be in writing and sent to the address of the recipient provided to the other party or such other address as the recipient may designate by notice given in accordance with this clause.  Any notice may be delivered personally by prepaid letter or by email (confirmed by prepaid post) and shall be deemed to have been served if by personal delivery when delivered, if by prepaid post 48 hours after posting and if by email when delivery receipt received by the sender (provided the email is confirmed by post).
  • These terms set out the entire agreement between us and to the extent permitted by law all implied statutory provisions are expressly excluded.
